These terms and conditions (with the Privacy Policy and the "Terms of Service" or "Agreement") govern your use of the website www.thinktag.co.uk and the recommendation engine "software as a service", collectively referred to as "Services".

The "Services" are provided by Thinktag Ltd ("we", "us" "our" or "Thinktag").

Please read the "Terms of Service Agreement" carefully before you start using the website or the recommendation engine "software as a service". By using our software, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, PLEASE REFRAIN FROM USING THIS WEBSITE AND THE RECOMMENDATION ENGINE SOFTWARE.

Thinktag reserves the right to amend or modify the "Terms of Service Agreement" from time to time without prior notice to you. If you are registered on the website we will inform you of the changes to "Terms of Service Agreement" via email. If you do not agree to any change to the "Terms of Service Agreement", please refrain from using the services.

Our Reliability

The Services we provide are reliant on third party software and hardware and as such we have limited control over extreme events that could arise. We make all attempts to limit any disruption to you and your website and to provide services in an efficient manner.

Your Eligibility

The Services are not intended for use by anyone under the age of 18. By using the Services, you confirm that you are 18 years of age or older. If you are under the age of 18, you may not, under any circumstances or for any reason, use the website or the services provided.

Your License to access the Services

Thinktag (after registration) hereby grants you a non-transferable, non-exclusive, non-sub-licensable, revocable, limited license to access to the recommendation engine software according to the "Terms of Service".

Our Liability

The Services we provide are without any guarantees, conditions or warranties to the extent permitted by law, we, and third parties software hereby expressly exclude: All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity. Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our website and services, including, without limitation any liability for:

  • loss of income or revenue;
  • loss of business;
  • loss of profits or contracts;
  • loss of anticipated savings;
  • loss of data;
  • loss of goodwill;

Rules of Conduct

  • make an attempt to discover the source code of the services or modify any trademarks of the services;
  • make an attempt to access the servers running the services in an illegal manner;
  • use the services in a manner that may subject thereof to any obligation for Thinktag to disclose or distribute the source code for the services;
  • provide inaccurate information about you or your business while registering on the website.

Terminating or Suspending your service

Thinktag reserves the right to limit or terminate the services or your access to the Software with prior notice via email if you are registered on the website. We also reserve the right to terminate or suspend the services due to technical issues or if you violate the terms of service or your license to use the service expires.

On expiration of the license we may without notice delete any data or meta data related to your business website that is registered on our website/services.

Jurisdiction and Applicable Law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site. These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
